DeWitt attorney Scott Paler was recently featured in a SHRM article examining the Equal Employment Opportunity Commission’s (EEOC) decision to rescind its 2012 enforcement guidance on the use of criminal background checks in hiring decisions.

The rescission marks a shift in the EEOC’s views on employers’ use of arrest and conviction records during the hiring process. However, employers remain subject to applicable federal, state, and local laws governing employment background screening.

In the article, Scott discusses the continued significance of state and local regulations, particularly as jurisdictions adopt their own requirements governing how employers may consider criminal history information in hiring decisions.
