On January 31, 2020, the U.S. Department of Homeland Security officially rolled out the new version of Form I-9 Employment Eligibility Verification.  The new form version (edition 10/21/19)  has replaced the prior version (edition 07/17/17), and is available on the U.S. Citizenship and Immigration (USCIS) website at www.uscis.gov/i-9.  The 10/21/19 edition will become mandatory as of April 30, 2020.  Up until that date, employers may use either the 10/21/19 or the 07/17/17 edition.

Using the incorrect form version generally constitutes a technical violation that may be subject to penalties in the event of a government audit.  Therefore, employers are encouraged to discontinue using the earlier version of Form I-9 and begin implementing the 10/21/19 edition effective immediately.

If you have any questions regarding the I-9 Employment Eligibility Verification process, or any other immigration-related matters, please do not hesitate to contact Attorney Raluca (Luca) Vais-Ottosen at rvo@dewittllp.com or 608-252-9291.
